What statutory requirements apply to the use of guarantees?

First, the guarantee must set out clearly and explicitly what it comprises/covers. In addition, information needed to exercise the guarantee must be stated, in particular information about the duration of the guarantee, its geographical scope and the name and address of the issuer of the guarantee.

At the same time, the guarantee must state that the consumer’s statutory rights are not affected by the guarantee. This especially refers to the right of complaint. Even though a car dealer, for example, gives a three month guarantee consumers may still invoke the statutory right of complaint for up to two years after the purchase.

You are entitled to obtain the guarantee in writing (or on another durable medium such as an email) if you so request.
